Terms of use

1. The agreement

These terms are an agreement between you and MoyoMatch, based in Nairobi, Kenya ("we" or "us"). They apply when you visit moyomatch.com, use the MoyoMatch web app or any MoyoMatch mobile app, and when you buy Moyo+.

By creating an account you accept these terms, our Community guidelines and our Privacy policy. If you do not agree, please do not use MoyoMatch.

2. Who can join

• You must be 18 or older. We remove accounts that belong to anyone younger.
• You may have one personal account. Accounts are not for businesses, agencies or anyone acting for someone else.
• You must not use MoyoMatch if you have been convicted of a sexual offence or a violent crime, or if a court has ordered you not to contact other people this way.
• You must not use MoyoMatch if we have closed an account of yours before, unless we agree in writing.

3. Your account

• Give true details about yourself, including your age and gender, and keep them up to date.
• Keep your password private. You are responsible for what happens on your account. Tell us straight away at hello@moyomatch.com if you think someone else has used it.
• You can pause your profile, download your data or delete your account at any time in Settings.

4. Your content

Your photos, videos, voice notes, profile text, moments, stories and messages stay yours. To run MoyoMatch we need your permission to store them, resize them, show them to the people you choose (for example everyone, or only your matches) and keep backup copies for a short time. You give us that permission, without payment, for as long as the content is on MoyoMatch and for the backup period described in our Privacy policy.

Only post content you have the right to share. Do not post other people's photos or personal details without their permission.

5. How you use MoyoMatch

Follow our Community guidelines. In particular, you must not:

• harass, threaten, bully, stalk or intimidate anyone, or post hate speech;
• ask anyone for money, M-Pesa transfers, airtime, gifts or investments, or run any kind of scam;
• advertise, sell or promote anything, including sex work or escort services;
• pretend to be someone else, or use photos that are not of you;
• share sexual content without the clear consent of the person receiving it, or share anyone's intimate images;
• use bots, scrapers or automated tools, or try to get around our security, limits or blocks;
• break any Kenyan law, including the Computer Misuse and Cybercrimes Act, 2018.

6. Moyo+ and payments

• MoyoMatch is free to join. Moyo+ is an optional paid upgrade for a fixed period (for example one week or one month). The price in Kenya shillings is shown before you pay.
• You pay with M-Pesa. Our payment partner IntaSend sends the request to your phone and Safaricom processes the payment, each under its own terms; we receive a confirmation and a transaction reference, never your M-Pesa PIN.
• Moyo+ starts once the payment is confirmed and ends at the end of the period you bought. It never renews by itself: to keep Moyo+, you buy another period.
• Refunds: if you were charged and Moyo+ did not start, we refund you in full to the M-Pesa number you paid from. Otherwise we do not refund unused time, except where the Consumer Protection Act, 2012 says we must.
• If we close your account for breaking these terms, unused Moyo+ time is not refunded.

7. Safety and other members

We check reports, review selfie verifications and remove people who break our rules, but we do not run criminal background checks and we cannot promise that every member is who they say they are. You are responsible for how you interact with other people, online and in person. Please read our safety tips before you meet anyone.

If you are in danger, call the police on 999 or 112.

8. Moderation and closing accounts

• We may remove content, limit features, pause or close an account if we reasonably believe it breaks these terms or the guidelines, puts someone at risk, or if the law requires it. Where it is safe to, we tell you why.
• If you think we got it wrong, write to hello@moyomatch.com and a person will look again.
• You can delete your account at any time in Settings.

9. Our responsibility

We work hard to keep MoyoMatch running and safe, but we provide it "as it is" and cannot promise it will always be available or free of errors. As far as Kenyan law allows, we are not responsible for what other members say or do, or for losses that were not foreseeable. Nothing in these terms limits rights you have under the Consumer Protection Act, 2012 or any other law that cannot be limited by agreement.

Where the law allows a limit, our total liability to you is limited to the amount you paid us in the 12 months before the claim.

10. Law and disputes

These terms are governed by the laws of Kenya. If we have a disagreement, please contact us first so we can try to sort it out. If we cannot, the courts of Kenya, sitting in Nairobi, will decide.

11. Changes and contact

We may update these terms as MoyoMatch grows. If a change is important we will tell you in the app or by email before it applies. Using MoyoMatch after that means you accept the new terms.
